Ontario Human Rights Code

Purpose

The Human Rights Code in Ontario is a provincial legislation that aims to promote equality and prevent discrimination in various social areas. Its primary purpose is to protect individuals from discrimination based on specific grounds and provide recourse for those who have experienced discrimination.

Protected Grounds

The Code protects the people of Ontario from being discriminated against or harassed on any of the following grounds:
  • Ancestry, colour, race
  • Age
  • Citizenship
  • Ethnic origin
  • Place of origin
  • Creed
  • Disability
  • Family status
  • Marital status
  • Gender identity, gender expression
  • Sex, including pregnancy and breastfeeding
  • Receipt of public assistance (in housing only)
  • Record of offences (in employment only)
  • Sexual orientation

Social Areas

The Ontario Human Rights Code is a provincial law that recognizes the dignity and worth of every person. The Code gives every person the right to equal treatment and equal opportunities in five areas (known as social areas):
  • Employment
  • Housing
  • Goods, Services and Facilities
  • Contracts
  • Membership in trade and vocational associations (such as unions)
The Code also has sections that prohibit:
  • Discrimination based on a person’s relationship or association with someone identified by the protected grounds mentioned above. This is called Association.
  • Retaliation or threats of retaliation against individuals who assert their rights or participate in legal processes related to the Code.
  • Retaliation or threats of retaliation for refusing to violate someone else’s rights.
  • Unwanted sexual advances or solicitation by someone in a position to grant or deny a benefit.
  • Retaliation or threats of retaliation for rejecting a sexual solicitation.

Examples of Human Rights Violations

These examples illustrate some of the human rights violations that can occur in employment, housing, goods and services, contracts, and membership contexts. It is essential to address and combat these violations to ensure equal treatment, fairness, and respect for human rights in all aspects of society.

Employment

  • Discrimination in hiring, promotion, or termination based on race, gender, age, disability, religion, or other protected grounds.
  • Pay inequity or unequal treatment in compensation and benefits.
  • Harassment or hostile work environment based on protected characteristics.

Housing

  • Discrimination in renting or selling properties based on race, religion, gender, disability, family status, or other protected grounds.
  • Unequal treatment in access to housing opportunities, services, or amenities.
  • Retaliation or eviction based on exercising one’s rights or filing complaints.

Goods, Services, and Facilities

  • Denial of services or unequal treatment based on race, religion, gender, disability, or other protected grounds.
  • Segregation or separate treatment in accessing public facilities, transportation, or accommodations.
  • Harassment or exclusion from public spaces based on protected characteristics.

Contracts

  • Unfair contract terms or conditions that exploit or disadvantage individuals based on their protected characteristics.
  • Refusal to honour contractual obligations due to discriminatory biases.
  • Discrimination in business transactions or dealings based on protected grounds.

Membership

  • Exclusion or denial of membership in organizations, clubs, or associations based on race, religion, gender, or other protected grounds.
  • Unequal treatment or restrictions imposed on members due to their protected characteristics.
  • Retaliation or harassment against individuals advocating for their rights within membership organizations.
